Terms of Service

Welcome to FlyBreezy. These Terms of Service ("Terms") govern your use of the FlyBreezy website and web application at flybreezy.app (the "Service"), operated by FlyBreezy, LLC, a Texas limited liability company ("FlyBreezy," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What FlyBreezy Is (and Is Not)

FlyBreezy is a flight search and comparison tool. We display estimated cash airfares and estimated points/miles redemption values side by side to help you decide how to book travel.

FlyBreezy is not an airline, travel agency, or ticket seller. We do not sell, issue, or book flights, and we never take payment for travel. When you choose to book a flight, you do so directly with a third-party booking site or airline, under their terms and prices. Any booking, change, refund, or customer service issue related to a flight is between you and that third party.

2. Accuracy of Information

Flight prices, availability, points estimates, and redemption values shown on FlyBreezy are estimates provided for informational purposes only. Prices change constantly and may differ from what you see when you complete a booking on a third-party site. Points and miles values are calculated estimates based on published program rates and may not reflect your actual redemption options, account status, or program changes. We do not guarantee the accuracy, completeness, or timeliness of any information on the Service, and you should verify all details before booking.

3. Accounts

Some features require an account. You agree to provide accurate information, keep your login credentials secure, and notify us of any unauthorized use. You must be at least 18 years old to create an account. You are responsible for activity under your account.

4. FlyBreezy Pro (Paid Subscription)

FlyBreezy Pro is an optional paid subscription (currently $4.99 per month, plus any applicable taxes) that provides premium features such as fare-drop alerts, award-seat alerts, and price history tools. Feature sets may change over time.

5. Affiliate Links and Third-Party Sites

FlyBreezy contains links to third-party booking sites and services. Some of these are affiliate links, meaning FlyBreezy may earn a commission if you click them or make a purchase, at no additional cost to you. We link to third parties we consider useful, but we do not control them and are not responsible for their content, prices, terms, or actions. Your use of any third-party site is governed by that site's own terms and privacy policy.

6. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) scrape, harvest, or systematically extract data from the Service, including by automated means; (c) resell, redistribute, or commercially exploit the Service's data or content without our written permission; (d) interfere with or disrupt the Service, or attempt to access it by means other than the interfaces we provide; (e) misrepresent your identity or affiliation.

We may suspend or terminate access for violations of these Terms.

7. Intellectual Property

The Service, including its design, text, graphics, logos, and software, is owned by FlyBreezy, LLC or its licensors and protected by intellectual property laws. FlyBreezy™ is a trademark of FlyBreezy, LLC. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. Flight data displayed on the Service is provided by third-party sources and remains subject to their rights.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PRICES AND AVAILABILITY SHOWN WILL BE HONORED BY ANY THIRD PARTY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYBREEZY, LLC AND ITS MEMBERS, MANAGERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR TRAVEL COSTS, ARISING FROM YOUR USE OF THE SERVICE OR ANY THIRD-PARTY BOOKING, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) FIFTY DOLLARS ($50).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless FlyBreezy, LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.

11. Changes to the Service or Terms

We may modify the Service or these Terms at any time. For material changes to the Terms, we will provide notice (for example, by email or an in-app notice) before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction, except that either party may bring an individual claim in small claims court.

13. Miscellaneous

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms are the entire agreement between you and FlyBreezy regarding the Service. Our failure to enforce a provision is not a waiver.
